An employer in California can no longer ask a job applicant about his salary history, according to the new law codified in AB 168.
A job applicant can volunteer to disclose his salary history, but an employer may not take the initiative to ask about it.
The purpose of Assembly Bill 168 is to reduce inequality. A company may make a lower offer to an applicant that has a low salary history, this perpetuating the inequality. This is especially a problem because women, minorities and people from poor socioeconomic communities often have a history of being paid less.
