This applies regardless of whether the games are classified as skill-based or chance-based, marking a shift from previous legal distinctions. The bill, cleared by both houses of Parliament on August 20-21, 2025, and awaiting presidential assent, prohibits offering, advertising, facilitating, or participating in such games, with penalties including up to three years in prison and fines up to ₹10 million (about $115,000) for operators, and similar punishments for endorsers like celebrities
Social and Psychological Harms: Officials cite widespread addiction, with reports of suicides, family breakdowns, and individuals losing life savings due to predatory algorithms, misleading ads, and easy access via mobile apps. IT Minister Ashwini Vaishnaw highlighted cases of "families getting destroyed every day" and compared the issue to a "big evil creeping into society," bigger than drugs in some views. Youth are particularly vulnerable, with over 450 million users in India (the world's largest gaming market) spending billions on these platforms.
Financial and Fraud Risks: The sector has been linked to fraud, cheating via rigged systems, and financial ruin. A 28% GST on deposits (introduced in 2023) was an earlier attempt to curb this, but harms persisted.Offshore operators already evade taxes, costing India over $4 billion in lost GST annually—more than the domestic industry's revenue.
National Security Concerns: Platforms are accused of enabling money laundering, illicit fund transfers via digital wallets and cryptocurrencies, and even serving as communication channels for terror groups. The Home Ministry played a key role in drafting the bill, emphasizing how offshore entities bypass Indian laws.
